Just a quick update on the reason for the change to Swing job 1302, the carrier has been presented with multiple circumstances in which the person protecting this assignment has abused the hours of service availability to manipulate his availability to fulfill the assignment in it’s current status so to allow us to keep the assignment instead of loosing a job we have worked with the carrier on developing a new assignment that will allow the person protecting the position will not have conflicting hours of service issues moving forward. At NO time do we have an official agreement that allows for us to go home during the tour of duty, we adjust our rest to allow for us to take the 4 hour break in service to continue with comingled service; our we fulfill the assignment until we reach the 12 hours & then we stop all railroad related duties and DH to our home terminal for the completion of the day.
